Terms of Service
These Terms of Service (the “Terms”) are a binding agreement between you and DeedDash (“DeedDash,” “we,” “us,” or “our”) governing your access to and use of the DeedDash website (deeddash.io), the DeedDash analyzer, and all related services (collectively, the “Service”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old to use the Service.
1. The Service
DeedDash provides software tools for real estate wholesalers and investors, including a deal-analysis tool that retrieves property information from third-party data providers and produces automated estimates — including estimated after-repair values (ARVs), comparable sales, repair cost estimates, and maximum-offer calculations based on adjustable formulas. DeedDash is a software provider only. We are not a real estate broker, agent, appraiser, lender, law firm, accounting firm, or financial advisor, and we are not a party to any transaction you pursue using the Service.
2. Estimates, Not Guarantees
ALL PROPERTY DATA, VALUATIONS AND ARVs, COMPARABLE SALES, REPAIR ESTIMATES, AND MAXIMUM-OFFER CALCULATIONS PROVIDED BY THE SERVICE ARE ESTIMATES PRODUCED BY AUTOMATED MODELS AND ALGORITHMS. THEY ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND ARE NOT GUARANTEES OF ANY PROPERTY’S VALUE, CONDITION, MARKETABILITY, OR PROFITABILITY.
Data displayed by the Service is obtained from third-party sources that we have no ability to audit line by line, and it may be inaccurate, incomplete, estimated, or out of date. Properties, asking prices, and market conditions change constantly. An ARV or other figure produced by the Service is not an appraisal, a broker price opinion, or an opinion of value prepared by a licensed professional, and it is not a commitment to buy, sell, lend on, or otherwise transact at any price.
You are solely responsible for independently verifying all information — including property condition, repair scope and costs, comparable sales, title, zoning, permits, taxes, and legal status — and for performing your own due diligence before making any offer, signing any contract, or making any business or investment decision. If you rely on the Service’s output without independent verification, you do so entirely at your own risk.
3. Not Professional Advice
Nothing provided by the Service is legal, tax, financial, investment, real estate, or other professional advice. Laws governing real estate wholesaling — including licensing, assignment of contracts, required disclosures, and advertising — vary by state and locality and change over time. You should consult qualified professionals, such as an attorney, a licensed appraiser, a tax advisor, and licensed contractors, about your specific situation.
4. Your Account
To use most features you must create an account with a valid email address and a password. You agree to provide accurate information, to keep your password confidential, and not to share your account credentials with anyone else. You are responsible for all activity that occurs under your account. If you believe your account has been accessed without authorization, notify us promptly at info@deeddash.io. We may suspend or restrict accounts that appear compromised or that violate these Terms.
5. Acceptable Use
You agree not to:
- Scrape, crawl, harvest, or use bots or other automated means to extract data from the Service, other than the analysis features we provide to your account;
- Resell, redistribute, sublicense, or republish the raw property data provided through the Service, or use it to build a competing data product;
- Use the Service or its output to send spam or other unsolicited communications, or in any way that violates anti-spam, telemarketing, privacy, or Do Not Call laws;
- Attempt to reverse engineer, probe, overload, or disrupt the Service, its security, or its data providers;
- Represent the Service’s automated estimates as appraisals, broker price opinions, or professional valuations; or
- Use the Service for any unlawful purpose or in violation of these Terms.
6. Your Responsibilities and Legal Compliance
You are solely responsible for complying with all laws, regulations, and licensing requirements that apply to your own wholesaling and investing activity, in every jurisdiction where you operate. DeedDash provides software tools only; it does not provide brokerage, agency, escrow, or legal services, and it is not a party to, and assumes no responsibility for, any agreement, negotiation, or transaction between you and any buyer, seller, lender, or other third party — even if you found or evaluated the opportunity using the Service.
7. Billing and Subscriptions
Certain features are offered free of charge, including beta access, which may be subject to usage limits (such as a monthly cap on analyses). Paid plans are billed in advance on a monthly subscription basis through our payment processor, Stripe, and renew automatically each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the then-current billing period, and you will retain access to the paid features until that date. Except where required by applicable law, all fees are non-refundable, and no refunds or credits are provided for partial months, unused analyses, or plan changes. We may change pricing or plan features on reasonable notice; changes apply to subsequent billing periods and never to a period you have already paid for. By subscribing, you authorize Stripe to store your payment method and to charge it for recurring fees and applicable taxes. DeedDash does not receive or store your full payment card number.
8. Intellectual Property
The Service, including its software, design, text, and branding (excluding third-party property data), is owned by DeedDash and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own internal business purposes. Property data delivered through the Service is licensed to you solely for evaluating your own prospective transactions and may not be redistributed as a standalone dataset.
9. Disclaimer of Warranties
THE SERVICE AND ALL DATA, ESTIMATES, AND CONTENT PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEDDASH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND COMPLETENESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PROPERTY DATA, VALUATION, OR ESTIMATE WILL BE ACCURATE, CURRENT, OR COMPLETE.
10. Indemnification and Hold Harmless
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless DeedDash and its owners, officers, directors, employees, agents, contractors, and affiliates (collectively, the “DeedDash Parties”) from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your access to or use of the Service; (b) your reliance on any data, estimates, valuations, comparable sales, repair estimates, or maximum-offer calculations provided by the Service; (c) any offer, purchase, sale, assignment, or other transaction or business decision you make in connection with the Service; (d) your violation of these Terms; or (e) your violation of any applicable law or the rights of any third party. You acknowledge that DeedDash is a software provider only, is not a party to any transaction you pursue, and is not responsible for the outcome of any deal, negotiation, or investment.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE DEEDDASH PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, FAILED OR LOST TRANSACTIONS, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TOTAL AGGREGATE LIABILITY OF THE DEEDDASH PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNTS YOU PAID TO DEEDDASH FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU PAID NOTHING, ONE HUNDRED DOLLARS (US $100)). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Termination
You may stop using the Service and close your account at any time by contacting us at info@deeddash.io. We may suspend or terminate your access, with or without notice, if you violate these Terms, misuse the Service, or where needed to protect the Service, our data providers, or other users. Sections 2, 6, 8, 9, 10, 11, and 14, and any payment obligations accrued before termination, survive any termination of your account or these Terms.
13. Changes to the Service and These Terms
We may update the Service and these Terms from time to time. When we make material changes to these Terms, we will post the updated Terms on this page and update the effective date and version shown above, and, where appropriate, notify you by email or within the Service. Your continued use of the Service after updated Terms take effect constitutes your acceptance of them. If you do not agree to a change, you must stop using the Service.
14. Governing Law; General Terms
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of those courts. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or struck to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy, are the entire agreement between you and DeedDash regarding the Service and supersede all prior or contemporaneous understandings about it. Our failure to enforce any provision is not a waiver of that provision or of the right to enforce it later. You may not assign these Terms or your account without our prior written consent; we may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or part of our business.
